Welcome to Rebecca Papillon. The terms “we,” “us,” and “our” refer to Rebecca Papillon. Rebecca Papillon operates this store and website, powered by Shopify, including all related information, content, features, tools, products, and services (the “Services”), in order to provide you, the customer, with a curated shopping experience.
These Terms of Service, together with any policies referenced herein (these “Terms”), describe your rights and responsibilities when you use the Services.

Section 2 — Our Products
We have made every effort to accurately represent our products and services. However, please note the following:
∙ Colors and appearance of original artworks and fine art prints may differ from how they appear on your screen due to your device type, settings, and calibration. Minor color variation is inherent to fine art printing and does not constitute a defect.
∙ Original artworks are one-of-a-kind pieces. Photographs and digital representations may not fully capture the texture, depth, or true color of the physical work.
∙ We do not warrant that the appearance or quality of any product will meet your expectations or exactly match its depiction on the Services.
∙ All product descriptions are subject to change at any time at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction.
Section 3 — Orders
When you place an order, you are making an offer to purchase. Rebecca Papillon reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance and receive payment.
Please review your order carefully before submitting. We may be unable to accommodate cancellation requests after an order is accepted.
If we do not accept, modify, or cancel an order, we will attempt to notify you via the email, billing address, or phone number provided at the time of the order.
All purchases are subject to our Refund & Return Policy, which is incorporated into these Terms by reference.
You represent and warrant that your purchases are for personal or household use only, and not for commercial resale or export.
Section 4 — Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as set out in your order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, handling, customs, or import charges.
You agree to provide current, complete, and accurate payment and account information for all purchases. You represent and warrant that the payment information you provide is true, correct, and complete, that you are authorized to use the payment method, and that you will pay all charges incurred, including applicable taxes and shipping fees.
Section 5 — Shipping and Delivery
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
Once we transfer products to a carrier, title and risk of loss passes to you. Please refer to our Shipping Policy for full details on carriers, processing times, and international shipping terms.
Section 6 — Subscriptions
The Animarii postcard subscription is a recurring subscription service. By subscribing, you authorize us to charge your payment method on a recurring basis at the frequency and rate selected at checkout.
∙ You may cancel your subscription at any time via your account portal to prevent future charges
∙ Subscription payments already processed are non-refundable
∙ Individual postcard prints within a subscription are not eligible for return or exchange
∙ Early subscriber pricing and any price locks are as described at the time of subscription
∙ We reserve the right to modify subscription pricing with reasonable advance notice to subscribers
Auto-renewal terms and cancellation instructions are provided at checkout and in your account portal.
Section 7 — Commissions
Commissioned artworks are subject to a separate Commission Agreement issued prior to work commencing. By paying a commission deposit, you agree to the terms of that Commission Agreement. Commission deposits are non-refundable once work has commenced or the deposit has been accepted. Please review the Commission Agreement carefully before consenting.
Section 8 — Intellectual Property
Our Services, including all artwork, trademarks, brands, text, displays, images, graphics, video, and audio, and the design, selection, and arrangement thereof, are owned by Rebecca Papillon or its licensors and are protected by U.S. and foreign copyright and intellectual property laws.
These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent.
Rebecca Papillon’s name, brand, artwork, product and service names, designs, and slogans are the intellectual property of Rebecca Papillon. You must not use them without prior written permission. Shopify’s name, logo, and trademarks are the property of Shopify Inc. All other trademarks on the Services are the property of their respective owners.
Nothing in these Terms grants you any license or rights under any intellectual property of Rebecca Papillon, Shopify, or any third party except as expressly stated.
Section 9 — Relationship with Shopify

Rebecca Papillon is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make are made directly with Rebecca Papillon. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Rebecca Papillon, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Rebecca Papillon.

The Services may contain links to third-party websites or tools. We are not responsible for the content, accuracy, or practices of any third-party sites or tools. Your use of third-party sites and tools is at your own risk. Any complaints or concerns regarding third-party products or services should be directed to the third party.
You may be provided with access to optional third-party tools as part of the Services. We provide access to such tools “as is” and “as available” without warranties of any kind. We shall have no liability arising from your use of optional third-party tools.

If you submit any ideas, suggestions, feedback, or reviews, you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, and distribute such feedback for any purpose, including to operate, improve, and promote the Services.
You represent and warrant that you own or have all necessary rights to any feedback you submit, and that your feedback will not violate any third-party rights or these Terms. We are under no obligation to maintain feedback in confidence, pay compensation for it, or respond to it.

We reserve the right to correct any errors, inaccuracies, or omissions on the Services at any time without prior notice, including after an order has been submitted. We may change or update information or cancel orders if any information is inaccurate.

No Agent may access the Services unless it identifies itself clearly in all requests and operates in strict accordance with our requirements. We may limit or block Agent access by technical means at any time. Agents must not mimic human behavior, circumvent CAPTCHAs, or conceal that interactions are automated.

We may terminate this agreement or your access to the Services at any time without notice at our sole discretion. You will remain liable for all amounts due up to the date of termination. Sections relating to Intellectual Property, Feedback, Disclaimers, Limitation of Liability, Indemnification, and Governing Law will survive termination.

EXCEPT AS EXPRESSLY STATED BY REBECCA PAPILLON, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.
Section 18 — Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, REBECCA PAPILLON, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES. SOME JURISDICTIONS DO NOT ALLOW LIMITATION OF LIABILITY, SO THE ABOVE MAY NOT FULLY APPLY TO YOU.

You agree to indemnify, defend, and hold harmless Rebecca Papillon, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys’ fees, arising out of your breach of these Terms, your violation of any law, or your use of the Services.
Section 20 — Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. You and Rebecca Papillon consent to the exclusive jurisdiction of the state and federal courts located in Santa Clara County, California for resolution of any disputes arising under these Terms.
Nothing in this section limits any rights you may have under the consumer protection laws of your own jurisdiction.
Section 21 — General Provisions
Severability: If any provision of these Terms is found to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force.
Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
Entire Agreement: These Terms, together with our Privacy Policy, Refund & Return Policy, and Shipping Policy, constitute the entire agreement between you and us regarding the Services.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
Headings: Section headings are for convenience only and do not affect interpretation.
